Customers of the dealership are given a free trial subscription to Sirius XM, which raises the value and attractiveness of the cars.
James Andrews, the plaintiff, acquired a pre-owned vehicle in California and was given a free trial subscription to Sirius XM. He filed a lawsuit after Sirius XM tried to get in touch with him over the trial subscription. His initial claim was that Sirius XM had gotten his contact information from the California DMV in violation of the DDPA, a law intended to prevent state DMVs from disclosing personal information without authorization. He kept his lawsuit even after Sirius XM informed him that it legally obtained his information thanks to its contract with the car dealership. Andrews claimed that Sirius XM had broken the DPPA by using data that eventually came from his own, voluntarily submitted driver’s license.
The Ninth Circuit U.S. Court of Appeals unanimously upheld the district court’s decision to reject Andrews’ claim. Id. at *6 (citing Sirius XM’s brief) notes that the DPPA “was not designed to address every abuse of personal information that occurred to emanate via a driver’s license.” Instead, its purview is restricted to unauthorized disclosures made by state DMVs and those who inquire of them. Id. The court determined that Sirius XM did not break the DPPA because “neither Sirius XM nor anyone else solicited or got his information from the California DMV.” Id.
The Ninth Circuit also upheld the district court’s decision to deny Andrews’ request to amend his complaint to include a claim under the Computer Fraud and Abuse Act (CFAA). Andrews claimed that Sirius XM misled the dealership into signing the data-sharing agreement, in violation of the CFAA. Even if that (inaccurate) claim were accepted, Andrews would not be able to make a claim under the CFAA. He had to demonstrate “loss to 1 or more persons… totaling at least $5,000” in order to do so. The Ninth Circuit rejected Andrews’ argument that the “lost potential” for him and his hypothetical class members to market their customer data met this condition. Any “revenue los[ses]” that fall under the CFAA’s definition of “loss” must be caused by a “interruption of service.” (Quoting 18 U.S.C. 1030(e)(11)) Id. at *7. Andrews’ lost marketing opportunity had nothing to do with a “interruption of service,” therefore allowing him to change his complaint would have been pointless. Id. at *8.
The Ninth Circuit’s majority ruling made it clear that companies can continue to properly collect and use consumers’ contact information without worrying about being subject to severe penalties under the DPPA or CFAA.
