For 2021, BMW standardizes on-demand 360L content on SiriusXM.
If you frequently switch between vehicles or travel outside the range of terrestrial radio, satellite radio is quite fantastic. Additionally, it is useful if you truly want to listen to only one thing nonstop, such as Bruce Springsteen or your preferred talk radio show.
Unfortunately, satellite radio is still programmed, just like terrestrial radio, thus you are at the mercy of others. With its on-demand 360L service, SiriusXM satellite radio is altering that, and BMW has already announced that it would begin installing it in almost all of its 2021 models this month.
By “nearly all of its vehicles,” we mean the 2 Series Gran Coupe, 3 Series, 4 Series, 5 Series, 8 Series, X3, X4, X5, X6, X7, and Z4 Roadsters that BMW has confirmed will be offered. For the time being, I Series vehicles, 2 Series coupes and convertibles, as well as X1 and X2 models, are effectively excluded.
Ralph Mahler, department director of BMW Product & Strategy, stated in a statement, “Just as we were back in 2002, we are excited to be one of the first [manufacturers] to offer the new SiriusXM with 360L service to our owners and drivers.” “To make driving your BMW an interesting experience every single day, delivering entertainment options is as important to us as providing a choice of how you desire to engage with your vehicle.”
All new BMW models with SiriusXM with 360L will come with a 12-month subscription to All-Access, which enables listening on mobile devices and connected home devices as well as through the SiriusXM app.
The SiriusXM system in the cars will also get over-the-air updates to enable new capabilities when they become available. Personalized stations, which will be powered by Pandora and function as ad-free, data-free Pandora for your car, are one such feature scheduled for 2021.
If you purchase a BMW later this year, there is a high chance that SiriusXM with 360L will be included in every 2021 model BMW built after July of 2020.
How can I tell whether the BMW I own has XM radio?
Go to the radio menu on your iDrive if you are a current BMW owner and are unsure whether your BMW has SiriusXM. If your BMW has SiriusXM, satellite radio will be offered alongside FM and AM.
Can my automobile have SiriusXM added?
You can add a new vehicle that has an SXM trial to an existing SiriusXM account if you already have one. Simply log in to the Online Account Center, go to the Get another subscription section, choose Car + Streaming, and then follow the on-screen directions. It is quick and simple, and your trial will not be lost.
What distinguishes my radio between Sirius and XM?
- On your stereo, look for the SiriusXM logo. The SiriusXM logo may occasionally be added to the radio by the automaker to promote the vehicle’s SiriusXM compatibility.
- To find the SAT button, look. There is usually a SAT button located someplace on automobile stereos with built-in satellite receivers. The button, which represents the satellite, acts as a gateway to SiriusXM stations. The SAT button is often located among the AM/FM and DISC AUX buttons.
- Consult the owner’s manual. Checking your owner’s manual should only be done as a last resort because the other two solutions are significantly simpler. Most likely, the section on your car’s audio system will have the details you require.
How does SiriusXM know that I just purchased a new car?
In a putative class action alleging violations of the Driver’s Privacy Protection Act, Jones Day successfully defended and won affirmance on behalf of Sirius XM Radio Inc.
In addition to working with auto dealers to ensure that people who buy Sirius XM-equipped automobiles may enjoy Sirius XM’s satellite radio service, Sirius XM collaborates with auto manufacturers to put Sirius XM-compatible equipment in new and used vehicles. When a consumer buys or leases a vehicle with Sirius XM technology, many car dealerships have agreements with Sirius XM that require them to legally give Sirius XM their customers’ contact information. Customers of the dealership are given a free trial subscription to Sirius XM, which raises the value and attractiveness of the cars.
James Andrews, the plaintiff, acquired a pre-owned vehicle in California and was given a free trial subscription to Sirius XM. He filed a lawsuit after Sirius XM tried to get in touch with him over the trial subscription. He claimed that Sirius XM had gotten his contact information from the California DMV in violation of the DDPA, a law intended to prevent the improper publication of personal information by state DMVs. He kept his lawsuit even after Sirius XM informed him that it legally obtained his information thanks to its contract with the car dealership. Andrews claimed that Sirius XM had broken the DPPA by using data that eventually came from his own, voluntarily submitted driver’s license.
The Ninth Circuit U.S. Court of Appeals unanimously upheld the district court’s decision to reject Andrews’ claim. Id. at *6 (citing Sirius XM’s brief) notes that the DPPA “was not designed to address every abuse of personal information that occurred to emanate via a driver’s license.” Instead, its purview is restricted to unauthorized disclosures made by state DMVs and those who inquire of them. Id. The court determined that Sirius XM did not break the DPPA because “neither Sirius XM nor anyone else solicited or got his information from the California DMV.” Id.
The Ninth Circuit also upheld the district court’s decision to deny Andrews’ request to amend his complaint to include a claim under the Computer Fraud and Abuse Act (CFAA). Andrews claimed that Sirius XM misled the dealership into signing the data-sharing agreement, in violation of the CFAA. Even if that (inaccurate) claim were accepted, Andrews would not be able to make a claim under the CFAA. He had to demonstrate “loss to 1 or more persons… totaling at least $5,000” in order to do so. The Ninth Circuit rejected Andrews’ argument that the “lost potential” for him and his hypothetical class members to market their customer data met this condition. Any “revenue los[ses]” that fall under the CFAA’s definition of “loss” must be caused by a “interruption of service.” (Quoting 18 U.S.C. SS 1030(e)(11)) Id. at *7. Andrews’ lost marketing opportunity had nothing to do with a “interruption of service,” therefore allowing him to change his complaint would have been pointless. Id. at *8.
The Ninth Circuit’s majority ruling made it clear that companies can continue to properly collect and use consumers’ contact information without worrying about being subject to severe penalties under the DPPA or CFAA.
