According to Bashall, the mandatory installation of location trackers could violate a person’s right to privacy and access to justice under the Human Rights Act and could constitute discrimination under the Equality Act.
She claimed that Motability had placed a “unreasonable requirement” on her as a disabled person with severe support needs who employs personal assistants.
Following the introduction of a number of other measures to address what it believes is “misuse and misrepresentation” by a small proportion of consumers, Motability has decided to install the tracking devices.
However, Bashall noted that it was also the most recent instance of “questioning the integrity of disabled persons” with regard to their benefits and entitlements by the government and larger society.
Among these are a number of unreliable and unfavorable media reports criticizing suspected fraud and abuse of the program, which allows disabled people receiving the higher rate mobility component of disability living allowance to lease a new car through Motability.
According to Bashall, installing tracking devices was “I find that demeaning and offensive,” he continued, “and I am quite concerned about the civil liberties issue.
“To track those who have committed crimes, we affix tags to them. I didn’t mean any offense.
“The government views all people with disabilities as essentially shysters, and society views all people with disabilities as cheats. It’s telling me that I could commit fraud, or my PAs could.”
The “location trackers” are being installed in new automobiles where “the risk of potential misuse is highest,” according to a Motability spokeswoman, with clients who have open insurance policies or who reside in care facilities.
She uttered: “Only in cases where we receive a report or have a suspicion that a car may be being used inappropriately will we have access to location data, and only then will we use it. It will not be used or looked at unless there is an allegation that raises suspicion.”
She stated that the tracker would be there to “defend the scheme and the customer” and might be used to exonerate disabled people who have been the target of false accusations.
She stated that less than 5% of the 600,000 cars leased through the program would have location trackers installed.
Bashall has questioned if the use of trackers will violate the Data Protection Act and has asked Motability how the data will be stored, who will have access to it, how long it will be kept, and for what purposes.
